UPON hearing counsel the Court made the following
O R D E R

Mr. B.S. Chahar, learned counsel states that the State of Sikkim does not desire to file affidavit.
We see no reason to interfere. The Special Leave Petition is dismissed. We, however, clarify that the trial court will not take into consideration any observations made in the impugned order or in the order of the District Judge dismissing the application.

Indian Supreme Court Awards Rumtek to Karmapa Charitable Trust
From the IKKBO News Service. New Delhi Today, India’s highest court decided that the Karmapa Charitable Trust is the sole authority over Rumtek Monastery.

In July 1997, The Karmapa Charitable Trust, the legal body given responsibility for Rumtek Monastery by H.H. the 16th Karmapa, filed a lawsuit against Tai Situ Rinpoche and Gyaltsab Rinpoche. The Karmapa Charitable Trust sought justice in the courts after Rumtek Monastery was violently taken over by Situ Rinpoche and Gyaltsab Rinpoche on August 2nd 1993.
